Applicable fines charged to customers
Passengers without the appropriate ticket or who do not have a valid or have an out of date document must pay an administrative fine provided by the normative in force (Art. 25 L.R. Toscana 42/98) from 40 euros to 240 euros in addition to the payment of the relative charge for the service used. The payment of the requested sum can be carried out as a minimum, at the moment of the fine, directly to the staff in control of the act, or it can be made 5 days afterwards (equal to 40 euros plus the cost of the ticket price for the journey made). The possibility to make the payment in a reduced measure (equal to double the minimum fine equal to 80 euros, plus the cost of the ticket for the journey made) must be carried out between the 6th and 60th day from the date of the incident or the same notification provided by art.8 of L.R. 81/2000.
Payment may be made with the conditions indicated by the fine itself. In the case where the customer doesn’t have the reduced form of payment, TRA.IN issues an obligation to pay the maximum charge which is necessary, as shown in art.16 of L.689/81. On the strength of art. 18 of Law 689/81 and of L.R. 81/2000 it is the customer’s responsibility to send the payment before 30 days from the incident or from the possible defensive written notification and/or the request to be listened to. Averse the payment of the charge, it is permitted to appeal to the ‘justice of the peace office’ in the area. Customers who do not have a ticket are given the 5 following days to verify their status, and must present themselves at the appropriate office. There, they must show that they have the correct ticket or season ticket which must have been stamped at a previous date. In this case they are not subject to paying the administrative fine, but pay administrative expenses amounting to 5,00 euros. Passengers who do not observe the further obligations (customer obligations) laid out by the Tuscan Region will be held to pay a fine from 10 to 60 euros. Failure to pay the fine before the 5 successive days from the issue of the fine will result in a fine equal to 10 euros; between the 6th and the 60th day, the fine will be equal to 20 euros. Beyond this period a fine will be issued for 60 euros. If there is a contradiction between the staff and the customer, the same rules of charges apply as stated in this paragraph.
